Welcome to the Connected Painting website.
These Terms and Conditions (“Terms”) govern your use of the Connected Painting website and your interactions with information, estimate requests, forms, advertisements, and other features available through our website.
By using this website, you agree to these Terms. If you do not agree, please discontinue use of the website.
1. About Connected Painting
Connected Painting is a painting contractor based in Winnipeg, Manitoba, Canada. We provide residential and commercial painting and related services. Services may include interior painting, exterior painting, cabinet painting, commercial painting, surface preparation, coatings, staining, and other services agreed upon with individual customers.
The specific services provided for any project will be determined by the written estimate, proposal, contract, change order, invoice, or other agreement applicable to that project. If these website Terms conflict with an accepted written project agreement, the written project agreement will govern the project.
2. Website Information
We make reasonable efforts to keep information on this website accurate and current. However, website information is provided for general informational and promotional purposes and may be changed or updated without notice.
Descriptions, photographs, examples, pricing references, timelines, warranties, promotions, and other website information do not constitute a binding project agreement unless specifically incorporated into a written agreement between Connected Painting and the customer.
3. Estimates and Quotations
Submitting an estimate request through our website, an advertisement, telephone, email, or another communication method does not create a contract or obligate Connected Painting to perform work.
Project pricing depends on factors that may include:
- Project size and scope
- Surface condition
- Preparation requirements
- Materials and coatings required
- Number of coats
- Access requirements
- Repairs
- Colour changes
- Labour requirements
- Scheduling
- Site conditions
- Other project-specific circumstances
An estimate becomes binding only as provided by the terms of the applicable written estimate, proposal, or contract and after any required approval or deposit has been received.
4. Hidden or Unforeseen Conditions
Painting and preparation work can sometimes reveal conditions that were not reasonably visible when a project was originally inspected or estimated.
Examples may include excessive peeling or failing coatings, damaged substrates, moisture-related damage, deteriorated caulking, drywall or plaster damage, previously concealed repairs, adhesion problems, hazardous materials, or other unexpected conditions.
If additional work is reasonably required because of conditions discovered after work begins, Connected Painting may discuss the additional work, pricing, and schedule with the customer before proceeding where appropriate.
5. Deposits and Payments
Deposit requirements, payment schedules, accepted payment methods, due dates, taxes, and outstanding balances will be governed by the customer’s applicable estimate, proposal, invoice, or contract.
A project may not be considered scheduled or confirmed until any required approval and deposit have been received. Failure to make a required payment may result in work being postponed or suspended, subject to the applicable agreement and law.
6. Scheduling and Project Dates
Connected Painting makes reasonable efforts to meet scheduled project dates. Unless expressly guaranteed in writing, start dates and completion dates are estimates.
Dates may change because of circumstances such as:
- Weather
- Surface or drying conditions
- Material availability
- Additional preparation or repairs
- Customer-requested changes
- Access to the property
- Other contractors or trades
- Equipment availability
- Safety concerns
- Events beyond our reasonable control
We will make reasonable efforts to communicate significant scheduling changes with affected customers.
7. Customer Responsibilities
Depending on the project, customers may be responsible for providing safe and reasonable access to the work area and completing any responsibilities identified in their project agreement.
Customers should inform Connected Painting of conditions that could affect the work, including known leaks, moisture problems, structural issues, hazardous materials, access restrictions, pets, security systems, or other relevant site conditions.
Customers are also responsible for obtaining any permissions or approvals assigned to them in the project agreement and for securing valuables and personal items as appropriate. Specific customer responsibilities will be governed by the applicable project agreement.
8. Colours and Finishes
Customers are responsible for approving final paint colours, sheen levels, finishes, and other selections unless otherwise stated in writing.
Colours displayed on phones, computers, printed materials, photographs, or digital mockups may appear different from the actual applied coating because of lighting, surrounding colours, screen settings, surface texture, sheen, and other factors.
Whenever colour accuracy is particularly important, customers are encouraged to approve a physical colour sample before full application.
9. Changes to the Scope of Work
Customers may request additions, removals, or modifications to the original scope of work. Changes may affect the project price and completion schedule.
Additional work outside the agreed scope may require written approval, an updated estimate, a change order, or other confirmation before the additional work is performed.
10. Materials and Products
Paints, coatings, primers, caulking, stains, and other materials may be selected according to the project requirements and the applicable agreement.
Product availability, manufacturer changes, discontinued products, or site conditions may occasionally require reasonable substitutions. Significant substitutions will be discussed with the customer where appropriate.
Where customers supply their own materials, Connected Painting cannot guarantee the performance, suitability, coverage, compatibility, or availability of those materials except to the extent expressly agreed in writing.
11. Workmanship and Warranty
Any workmanship warranty that applies to a project will be described in the customer’s written estimate, proposal, contract, warranty document, or other applicable written agreement. The applicable document will state the warranty period, coverage, exclusions, and remedies.
Warranty coverage may not apply to failures or damage caused by circumstances outside Connected Painting’s workmanship, including, where applicable:
- Water intrusion or moisture
- Structural movement
- Building or substrate failure
- Previous coatings or underlying materials
- Customer-supplied products
- Normal wear and tear
- Impact or physical damage
- Mould or biological growth
- Extreme environmental conditions
- Work performed or altered by others
- Conditions specifically excluded by the applicable project agreement
Manufacturer warranties, if any, are subject to the manufacturer’s own terms. Nothing in these Terms limits any rights or remedies that cannot lawfully be excluded under applicable law.
12. Photographs and Project Images
Connected Painting may photograph work for project documentation, quality control, estimating, or warranty purposes.
Project photographs will not intentionally include personally identifying information. Photographs used for marketing will be used only with appropriate permission, and reasonable efforts will be made to avoid displaying personal information, addresses, licence plates, security details, or other identifying information.
Customers who have concerns about photography at their property should notify Connected Painting before work begins.
